By using this website and ordering from Kelley Turkeys USA, LLC, a Virginia limited liability company (“KT”, “us” or “we”), you agree to be bound by the Terms and Conditions set forth herein. These Terms and Conditions govern the supply of goods sold by KT to you and constitute the entire and only agreement between us in relation thereto.

Order Acceptance The completion of the contract between you and us will take place on the dispatch to you of the products ordered, unless we have notified you that we do not accept your order. Non-acceptance of an order may be a result of one of the following: (i) the product you ordered being unavailable, and us being unable to fulfil your order; (ii) our inability to obtain authorisation for your payment; (iii) the identification of a pricing or product description error; or (iv) your failure to meet the eligibility to order criteria set out below. Where your order has been accepted via a card payment over the Internet and we decide for any reason we cannot accept your order, we will notify you via email and refund your monies in full back to the credit card used for the transaction or by check. Any contract to supply the said goods will become void and KT will not be liable to you for any consequential losses of any kind. Eligibility to Order

 

You must be legally entitled to use the credit card on which you make the transaction. You are required to input correct delivery address details. The order may be declined after processing should the delivery address not be traceable or if there is a mistake in the delivery address.

 

Delivery & Title We will deliver the goods in accordance with your order. Upon delivery of the goods to you, the goods shall be at your risk. In spite of delivery having been made, title in the goods shall not pass to you until you have paid the price for the goods in full and no other sums whatsoever shall be due to us from you. Until title in the goods passes from us, you shall hold the goods on a fiduciary basis as bailee and shall store the goods at your own cost separately from all other goods in your possession and marked in such a way that they are clearly identified as our property. Availability While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we will inform you via email or telephone and offer an alternative product or refund you the price paid for such goods. Order Cancellation You may cancel your order by giving us notice of cancellation at least ten (10) days prior to your scheduled delivery date. Such notice may be given by calling 540.724.1654. We will acknowledge receipt of your cancellation and refund the card account on which the goods were purchased. Refunds Because of the nature of its products, KT generally does not accept returns after delivery of your goods. In the event that you are not satisfied with the products that you purchase from us, then, within 24 hours after your receipt of your order, you will: (i) email usa@kellyturkeys.com or call 540.724.1654 to report, with reasonable specificity, your dissatisfaction; (ii) take a digital photograph of the products; and (iii) store the products in your refrigerator or freezer if they are fresh or frozen products. You agree that the decision to issue a return, refund or allowance is at the sole discretion of KT. You acknowledge that your order contains products that must be stored at certain temperatures, and you agree to accept delivery of all products that you order from KT. You will not be entitled to any return, refund, or allowance if there was no one present to receive your delivery at the shipping address on the designated delivery date. Any refund issued by KT will be credited to the same credit card used to make your purchase. Force Majeure We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, failure of the carrier, adverse weather conditions, strikes, lockouts and other industrial disputes).
